Johnny Brian Altinger, 38, was reported missing October 10th, 2008. On October 31st Mark Andrew Twitchell, 29, was charged with first-degree murder.



Twitchell's film "House of Cards" was a small project to be completed before he launched production of "Day Players" with a $3.5 million budget.


"Day Players" was the subject of two lawsuits after a pair of investors had put up a total of $65,000 and felt that Twitchell would never complete the film.


In a statement of claim filed November 5th, 2008, chartered accountant John Pinsent alleged he provided Twitchell with a $35,000 cheque, made out to Xpress Entertainment Inc., on October 27th. The cheque was cashed the next day and Twitchell was arrested three days after that.


Pinsent alleged the payment was part of an executive producer agreement and he was to be reimbursed prior to principal photography starting. In the arrangement, Pinsent was to be granted one profit point, about 1% of the net profit of the film.


With Twitchell in jail, Pinsent alleged the film would not be completed, preventing his investment from being returned and denying him any potential profit. Pinsent asked for a declaration that would hold the $35,000 in trust, or an order directing Twitchell to return the money.


Travis Theberge filed a statement of claim on November 6th, 2008 against Twitchell and Xpress Entertainment. Theberge sought the return of $30,000 plus interest on funds he said he advanced to Twitchell.


Theberge's statement of claim did not detail the reason for the money being advanced, but alleged the money was due and that Theberge's requests for payment were unsuccessful.
